You need to continue regular car payments, maintain vehicle registration, and then transfer the car’s ownership. You cannot drive the car unless you have proper registration, and penalties will be charged if this is not done on time.

Will Designating Executor or Administrator

If an executor or administrator has been appointed by the court, the following must be completed/and or filed at the county tax assessor’s office in the county where the deceased was living during time of death (you can find the address of your county office here):

• Letters of Testamentary from probate court
• A completed Form 130-U “Application for Texas title and/or Registration”
• Vehicle title
• Proof of liability insurance
• Proof the vehicle passed inspection
• A registration fee

No Will

If the deceased left no will, the heir or heirs must complete and/or file the following forms at the county tax assessor’s office in the county where the deceased was living during time of death (you can find the address of your county office here):

• A completed Form 130-U “Application for Texas title and/or Registration”
• A completed Form VTR-262 “Affidavit of Heirship for a Motor Vehicle”
• Vehicle title
• Proof of liability insurance
• Proof the vehicle passed inspection
• A registration fee
